General Terms and Conditions of Sale for non-contracted treatments

Scope of application

The general conditions below specify and complete the provisions of the Civil Code and the Consumer Code. They apply to the contractual relationship between the Thermes de Bourbonne-les-Bains (1 place des Bains 52400 BOURBONNE-LES-BAINS) and a customer whose cure and services are not covered by a compulsory national or Community health insurance scheme (health cures, complementary programmes, wellness-related services, etc.). These general conditions also apply to the sale of cosmetic products.

Article 1 - PRICES

For cosmetic products, the applicable prices are those in force on the date the order is placed by the customer.

For services, the applicable prices are those displayed (in the sales documentation and on the website), for the period concerned, at the time of the request for pre-reservation on the website or reservation of the service. Any change in price and the date on which it comes into force will be communicated by display or by any other means defined by the company.

Prices include VAT and are denominated in euros.

Prices may be changed by Les Thermes de Bourbonne-les-Bains, at its convenience and at any time without notice. Price changes and, where applicable, the date from which the changes come into force will be notified to the customer before any order, by any means.

Certain prices and services may be subject to special access and pricing conditions, linked to the order period, the marketing methods (per unit, in a package or other) and the company's opening periods. These conditions are specified on the documentation specific to the establishment or on the admission ticket or any other similar document.

The time taken for treatments (per treatment or as part of a package) includes installation and removal time. The sale cannot be considered complete unless the customer has first validly paid the full price and the establishment has confirmed the availability of the service. No service may be provided until the sale has been completed.

Article 2 - RESERVATIONS

2.1 - Payment of deposit: to guarantee the effectiveness of a reservation, a customer must send in a duly completed reservation form or place an order by telephone, and then pay the full amount for the service. Reservations are only guaranteed once the establishment has confirmed the availability of the service and, in the case of online or distance sales, once the 14-day withdrawal period stipulated in article L.221-18 of the French Consumer Code has expired.

2.2 - Deposit amount: for all services, including mini health cures and themed cures, the deposit amounts to 100% of the total amount of the services purchased.

2.3 - Conditions for return of deposit: the customer has the right to cancel the booking free of charge, subject to the following deadlines:

  • For mini-cures and themed cures, the cancellation must be made at least 7 days before the planned date of the service,
  • For bookings for services within the SPA, cancellation must be made at least 72 hours before the start of the booked service.

If these minimum cancellation deadlines are not respected, the deposit cannot be returned to the customer.

No cancellation period applies if a death certificate or medical certificate is provided to prove that the customer is unable to take advantage of the service.

Cancellations must be sent to the spa with any supporting documents. The date taken into account is the date of receipt of the correspondence by the Thermes de Bourbonne-les-Bains.

Article 3 - PROVISION OF THE SERVICE

3.1 - Times and progress of the service

The days and times of the services are fixed by mutual agreement, depending on the availability of the establishment, which endeavours to satisfy customer requests as best it can. These days and times are binding. Changes to days and times are only possible with the agreement of the establishment and for medical reasons.
With the exception of gift vouchers, services are sold personally. Services are not modifiable, transferable or assignable. They cannot be postponed or split up. The different treatments that make up a package or a treatment programme can only be given to the same person. In the interests of continuous improvement, SPA services are subject to change each year. If the chosen service is no longer available for sale, the customer will be offered another service at an equivalent price.

3.2 - Medical contraindications

It is the sole responsibility of the customer to ensure in advance that he/she does not suffer from any contraindication to the provision of a service, with or without assistance from the establishment. For all requests for assistance, the establishment must be contacted before booking to confirm capacity.

3.3 - Service not provided

When a service cannot be provided due to the fault of the establishment, the establishment will endeavour to provide a replacement service of equivalent value. If the customer refuses the replacement service, a credit note valid for one year will be issued, which may be reimbursed at the end of this period. Only any prejudice directly and exclusively linked to a partial or total non-performance of the object of the contract may be taken into account.

3.4 - Exceptional extension of the term of a subscription or package and exceptional cancellation of a subscription

The validity dates of services sold individually, in packages or by subscription cannot be extended.
However, a subscription or package may be suspended on presentation of the admission ticket in the following three cases: hospitalisation of the customer following surgery, maternity, temporary total incapacity to work lasting more than one month. The customer must provide the establishment with a medical certificate confirming the situation as soon as possible. The postponement is equal to the duration of the inability to benefit from the subscription or package, but may not exceed 6 months and runs from the date of the request.
If, for medical reasons, a customer is permanently unable to benefit from their subscription or package, they may request its cancellation.

3. 5 - Conditions of access to the Thermes de Bourbonne les Bains: access to services may be subject to various health and/or safety constraints and restrictions. The customer must be aware of these before making any reservation (available on notice boards, at reception, in the establishment).

3.6 - Rules and regulations of the establishment: it is imperative to respect the rules and regulations of the establishment, as well as the rules applicable to hygiene and, more generally, any instructions issued by a member of the establishment. Certain services are subject to age conditions: the establishment manager or his/her delegate may ensure that the minimum age is respected, and proof of identity and age must be produced for this purpose. No credit note or refund will be issued to a customer who has been excluded by the establishment because of a breach of the house rules or behaviour that is contrary to public order.

Article 4 - ORGANISATION AND SALE OF TOURISM HOLIDAYS AND PACKAGES

Services including treatments and accommodation are sold by the reservation service of the Thermes de Bourbonne les Bains. These services are subject to the general terms and conditions of sale applicable to stays and tourist packages, which are available on request.

Article 5 - SALE OF COSMETIC PRODUCTS

The products offered for sale are available while stocks last. The list of available products may change at any time. Delivery charges are payable by the customer and are invoiced with each order.

Article 6 - RESPONSIBILITY OF THE ESTABLISHMENT

The information and visuals contained in the brochures and documentation provided by the establishment have no contractual value and are for guidance only. They are subject to change without notice.

The establishment may not confirm a reservation or accept an order for a given date, depending on the level of occupancy observed. The Customer is informed of this temporary unavailability at the time of requesting the reservation or order and may be offered an alternative date.

The establishment cannot accept jewellery, cash, watches, means of payment and, more generally, any personal effects of a certain value. Nor can it be held responsible in the event of force majeure, strike action or the actions of a third party outside the establishment.

Article 7 - COMPLAINTS, MEDIATION AND APPLICABLE LAW

Any complaint must be notified in writing as soon as possible to the spa establishment concerned, so that a solution, if appropriate, can be found to the problem raised.

For any dispute falling within the scope of the Consumer Code alone, excluding disputes relating to a health service, the Thermal Spas Ombudsman can be contacted on the website www.mediateurduthermalisme.org or by post at the following address:

All clauses in these general terms and conditions of sale are subject to French law.

Article 8 - PERSONAL DATA

Les Thermes de Bourbonne-les-Bains collects personal data from customers when making a reservation by telephone, by post or when creating a customer account on the website. The following data is collected: title, surname, first name, address, email address and telephone number.

Purposes and recipients of the data: only Les Thermes de Bourbonne-les-Bains, in its capacity as data controller, its service providers and subcontractors are recipients of the personal data collected from customers.

Personal data is collected for the following purposes:

  • management of the booking or order (including booking operations, follow-up, payment, satisfaction assessment and information) and the preparation of studies and statistics,
  • sending the customer commercial and advertising information according to their preferences (by e-mail and/or SMS) subject to their prior agreement (boxes to be ticked when booking or ordering).

Individual rights: the collection and processing of personal data is based on the Customer's consent, which is given by ticking a box at the time of booking. In accordance with the regulations on the protection of personal data, the Customer has the following rights: right of access, opposition, rectification, limitation, deletion and portability of the data provided. The customer has the right to lodge a complaint with a supervisory authority.
